  1. PERSONAL INFORMATION COLLECTED AND SHARED

  1. When Personal Information Is Collected. We only collect Personal Information about you when you provide it to us directly on the Site, or provide it to one of our affiliates. For example, if you decide to complete a user registration form, complete an online survey, request a service, or make a purchase, you may be asked to provide certain information about you such as your contact information (name, email address, mailing address, and telephone number). If you decide to place an order, we will also need to know your delivery and billing address, credit card number and expiration date. To protect your Personal Information, users registering at the Site must adopt a user name and password as part of the registration process. However, a user may purchase items through the Site without registering, i.e., as a “Guest.” If you purchase items as a Guest, your order history will become part of our records, but we will not have a profile of you. When you submit Personal Information on this Site, the information you provide may be shared with our affiliates that distribute and market Bond No. 9 products (the “Group Companies”). Group Companies may use this information in accordance with this Privacy Policy. Group Companies may be located both inside and outside the United States (“US”) and the European Union (“EU”). By providing Personal Information you consent to the disclosure to and use of your Personal Information by Group Companies and acknowledge and accept that the Group Company located outside of the United States which receives your Personal Information may be located within a state or country which does not guarantee the same kind or level of protection for Personal Information as the one in which you reside.
  3. Disclosure of Personal Information in Certain Cases.
    1. Except as specifically provided in this Privacy Policy, we will not provide your Personal Information to third parties for their use in marketing their products or services to you without your consent. Group Companies are not considered third parties for these purposes, but instead are considered affiliates within the Bond No. 9 Group Companies and this Group is considered one company for the purposes of considering whether Personal Information is transferred to a third party.
    2. We may disclose any information, including Personal Information, we deem necessary, in our sole discretion, to comply with any applicable law, regulation, legal process or governmental request. We may also exchange information, including Personal Information, with other companies and organizations for credit fraud protection and risk reduction.
    3. We may retain other companies and individuals to perform functions on our behalf. Examples include customer support specialists, webhosting companies, credit card companies, fraud checking companies, fulfillment companies (e.g., companies that fill product orders or coordinate mailings), data analysis firms and email service providers. Such third parties may be provided with access to such of your Personal Information needed to perform their functions. We have written agreements with such service providers that provide that the service provider may not use such information for any other purpose other than that for which they have been retained.
    4. If you elect to participate in any promotions, sweepstakes, surveys, questionnaires or other events during your visit to our Site, the rules or terms and conditions for those events may indicate that your Personal Information will be shared with third parties. By choosing to participate and submitting your Personal Information with respect to such events, you consent to disclosure of your Personal Information to such third parties.     To analyze the consumer’s contacts with us, the consumer’s interests, preferences and purchase habits.

    To determine how to provide the consumer with better service, including, if applicable, to provide the consumer with invitations to visit our boutiques.

    The consumer may unsubscribe or opt-out from our registration system at any time. Unsubscribing or opting out does not prevent the consumer from using the services or making purchases in any way, but we will not be able to inform the consumer of marketing initiatives described above and we cannot determine his or her interests and offer a more personalized shopping experience.

Biometric information includes, but is not limited to, imagery of the iris, retina, fingerprint, face, hand, palm, vein patterns, and voice recordings, from which an identifier template, such as a faceprint, a minutiae template, or a voiceprint, can be extracted, and keystroke patterns or rhythms, gait patterns or rhythms, and sleep, health, or exercise data that contain identifying information.

Your Personal Information may be shared if we seek investors or to go through a business transition, such as a merger, acquisition by another company, or a sale of all or a portion of our assets. Personal Information will likely be among the assets transferred in the event of a sale or partial sale of our assets or equity in our business.
  5. USE OF AGGREGATE INFORMATION

We may use the Personal Information you provide to us in aggregate (non-personally identifiable) form for internal business purposes, such as generating statistics and developing marketing plans. In addition, we may collect, store or accumulate certain non-Personal Information concerning your use of the Site, such as information regarding which of our pages are most popular. We may share or transfer non-Personal Information with or to our affiliates, licensees and Group Companies.

CHILDREN

We do not knowingly request, collect, use or disclose Personal Information from anyone under sixteen (16) years of age. If we become aware that we have unknowingly collected Personal Information from anyone under sixteen (16), we will make reasonable efforts to delete it from our records and cease sending any requested promotional communications. Any shopping account will also be deleted.

SECURITY AND CONFIDENTIALITY OF PERSONAL INFORMATION

We implement various commercially reasonable physical, electronic and administrative security measures in accordance with industry standards to protect the security of your Personal Information both online and offline. We designed the Site to accept orders only from Web browsers that permit communication through Secure Socket Layer (SSL) technology. CHANGES TO THIS POLICY

  1. Changes. We may revise this Privacy Policy from time to time. If we decide to change this Privacy Policy, we will post the revised Privacy Policy in the same place as this Privacy Policy is posted and we will state the date that the Privacy Policy was last updated. We have the right to make changes at any time without notifying you. Therefore, we suggest that you periodically consult this Privacy Policy to see if it has been changed. Please note that our rights to use your Personal Information will be based on the Privacy Policy in effect at the time the information is used.
  2. Updating Your Information. You have the ability to review, change and/or correct the Personal Information you provide us by emailing us at contactus@bondno9.com. If you are a registered user, you can also review, change or correct your Personal Information at any time by logging into your Bond No. 9 Online account. You may request that we deactivate your account by emailing us at contactus@bondno9.com. Please remember to specify the reason for each contact attempt when emailing us.

CHOICE/OPT-OUT

  1. You may opt-out of receiving future emails from us when you register at the Site or otherwise provide your contact information to us. This opt-out right also applies to receiving promotional, service or business related emails. You may change your preferences that is part of your information at any time by revising your profile or by clicking the “Unsubscribe” link at the bottom of any opt-In or email you receive from us and follow the instructions provided therein, or by emailing us at contactus@bondno9.com.
  2. We do not make any representations or warranties about any third-party opt-out services. Those services are independent from us, and we have no control over, or responsibility for, their performance. Even if you use any third-party opt-out tools, we may still collect some data about your online activity for operational purposes (such as fraud prevention), but it will not be used by us for the purpose of targeting marketing materials to you.   4. Registered users may terminate their registrations at any time, for any reason, by contacting us. You understand it may be impossible to delete Personal Information entirely because of backups and records of deletions. If you wish to cancel your account on the Site or delete your Personal Information previously provided to us, you may send your request to us at contactus@bondno9.com and include the words “Delete My Information” in the subject line, with your specific request in the body of your communication. Please also update your Personal Information if it changes. Please note that it may be impossible to delete Personal Information entirely because of backups and records of deletions.
  5. Even if you request that we delete your Personal Information, note that information associated with past transactions or archived information on the Site cannot be deleted except in accordance with our data retention policy.
  6. If you do not receive a response from us to any emails you send to us within ten (10) business days, please send us another email because your original email may not have been properly received or distributed.

CALIFORNIA RESIDENTS’ PRIVACY RIGHTS

  1. Right to Know - Categories of Personal Information Disclosed. You have the right to request that we disclose to you certain information about our collection and use of your Personal Information over the past twelve (12) months. In the last twelve (12) months, we have disclosed to consumers in California each of the categories of Personal Information described in Section 2.10 of this Policy that has been furnished to us and that has been disclosed to service providers for purposes that include fulfilling orders, processing payments, conducting site and data analytics, and maintaining the security of the Site. Once we have received your request and confirm your identity, we will disclose to you (a) the categories of Personal Information that we have collected about you, (b) our business or commercial purpose for collecting or sharing that Personal Information, (c) the categories of third parties with whom we shared that Personal Information and (d) the specific pieces of Personal Information that we collected about you (for Data Portability).

    • Right to Access/Know – the right to request that we disclose to you (i) all of the Personal Information that we collected about you in the preceding twelve (12) months, the business purpose for such collection, and the categories of sources from which we collected the Personal Information, and (ii) the categories of Personal Information, and the categories of third parties with whom we shared your Personal Information in the preceding 12 months, and the business or commercial purpose for such disclosures.
    • Right to Delete – the right to request that we delete any Personal Information that we have collected about you. Note that there may be some reasons we will not be able to fully address your request, such as if we need to complete a transaction for you, or to comply with a legal obligation, we may delay responding to your request. Upon verification of your request we shall notify third parties with whom we have shared your Personal Information to delete that information.
    • Right to Correct – the right to request that we correct Personal Information that we have collected about you that is incorrect.
    • Right to Opt-out of Sale or Sharing – the right to require that we cease selling or sharing of any Personal Information that we have collected about you.
    • Sensitive Personal Information – the right to require that we cease disclosing “Sensitive Personal Information” to third parties if we are using it for a purpose other than the services you requested. “Sensitive Personal Information is defined in Section 1798.121 of the CCPA.
    • Opt-out of Automated Decision Making – the right to require that we cease using automated decision making regarding you, including profiling, using any Personal Information we have collected about you.
    • Right to Limit – the right to request at any time that we limit the use of Sensitive Personal Information about you to those uses which are is necessary to perform the services or provide the goods for which the information was provided.

We may request certain information to verify your identity before we can respond to your request. We will confirm receipt of a request to delete, a request to correct or a request to know and begin processing the request in ten (10) business days. If we cannot comply with the request we will provide information to you on how to submit the request or to remedy any deficiencies with a request already made, as applicable.

    If you want to opt-in to the sale or sharing of your Personal Information after you have opted-out, please contact us at the e-mail address or phone number set forth herein. We value your privacy and will not discriminate against you in any way if you exercise your privacy rights.

    We do not “sell” (as that term is defined under the California Consumer Privacy Act) Personal Information.
  5. Notices of Financial Incentive. When we offer financial incentives (“Financial Incentives”) online or in our retail stores, we will advise you of the following where you encounter a Financial Incentive:
    • a succinct summary of the Financial Incentive or price or service difference offered;

  6. Sensitive Personal Information. We do not ask for and do not collect your “Sensitive Personal Information” as defined by California Civil Code §798.121 et. Seq. so the “Right to Limit” the use and disclosure of such Sensitive Personal Information does not apply.
  7. Agent Requests. You may authorize someone to make a privacy rights request on your behalf (an “authorized agent”). Authorized agents will have to demonstrate to us that you have authorized them to act on your behalf, or must demonstrate to us they have a power of attorney pursuant to applicable law. We retain the right to request confirmation directly from you confirming that the agent is authorized to make such a request regarding your privacy rights, or to request additional information to confirm the agent’s identity.
  8. Shine the Light. California’s “Shine the Light” Law (California Civil Code §1798.83) includes a right to ask us for information relating to the disclosure of Personal Information to third parties for their direct marketing purposes.
